This Agreement governs the use of the software "Auditor" version 0.4.5, hereinafter referred to as the "SOFTWARE", developed by Antônio Cesa da Silveira Júnior, hereinafter referred to as the "AUTHOR".
1. LICENSE GRANT – NON-COMMERCIAL USE: The AUTHOR grants the user a non-exclusive, non-transferable, and royalty-free license to use the SOFTWARE, under the following conditions:
a) The SOFTWARE may be used solely for non-commercial purposes, including personal use, education, academic research, and activities carried out by public sector entities;
b) Permitted users include individuals, government institutions, non-profit organizations, and educational or research institutions — provided no commercial activity is involved.
2. PROHIBITION OF COMMERCIAL USE: Commercial use of the SOFTWARE is strictly prohibited without a separate license granted by the AUTHOR.
"Commercial use" includes, but is not limited to:
- Use within any company or organization operating for profit;
- Use as part of a paid service or product;
- Use in consulting, paid training, or service provision;
- Use that results in direct or indirect financial gain.
Any unauthorized commercial use constitutes a breach of this Agreement and may result in legal action.
3. INTELLECTUAL PROPERTY: The SOFTWARE is proprietary and protected by applicable copyright laws. The user does not acquire ownership or any rights to the source code, which remains closed and exclusively owned by the AUTHOR.
4. RESTRICTIONS: The user may not:
- Modify, reverse engineer, decompile, or disassemble the SOFTWARE;
- Redistribute, resell, or sublicense the SOFTWARE;
- Remove or obscure any copyright or licensing notices.
5. DISCLAIMER OF WARRANTIES
The SOFTWARE is provided “as is”, without warranties of any kind,
express or implied, including but not limited to merchantability,
fitness for a particular purpose, and non-infringement.
6. TERMINATION
This license will automatically terminate if the user fails to comply
with its terms. Upon termination, the user must cease all use of the
SOFTWARE and destroy all copies.
7. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with
the laws of Brazil, State of Santa Catarina, without regard to its
conflict of law provisions.
